An Appeal Court sitting in Abuja, the Federal Capital Territory has rejected an appeal by the suspended DCP Aba Kyari, who sought the reversal of an earlier rulling of the federal high court in Abuja, which refused his request for bail.
Justice Adah, who read the unanimous judgement of a three-member panel, held that the suspended police boss’ appeal was without merit.
According to Adah, in view of the nature of the charges pending against him and four others before the trial court, such request needs to be handled with utmost caution.
However, he held that the former justice of the Abuja high court, Emeke Nwite, who rejected Kyari’s request initially, appropriately used his discretion by refusing to grant the bail.
It would be recalled that Kyari, who was the head of the intelligence Response Team of the Nigerian Police Force and four other members of the squad; ACP Sunday J. Ubia, ASP Bawa James, Inspector Simon Agirgba and Inspector John Nuhu are being prosecuted by the National Drug Law Enforcement Agency, before a federal high court in Abuja.
