A Federal High Court sitting in Abuja has set March 22, 2022 to rule on an application filed by the former head of Intelligence Rapid Response Team of the Nigerian Force CP Abba Kyari and four other accomplices to dismiss cocaine dealings trial levelled against them.
Kyari and the four accomplices are challenging the authority of the court over alleged complicity in cocaine dealings case levelled against them.
The National Drug Law Enforcement Agency approached the court to prosecute Kyari and other four members of the Intelligence Response Team, ACP Sunday J. Ubua, ASP Bawa, James, Inspector John Nuhu and Inspector Simon Agirgba.
Kyari and the four suspended police officers are however, challenging the competence of the criminal case which they are being tried of.
They were all charged with conspiracy to deal in 17.55kg of cocaine; dealing in cocaine without lawful authority, conspiracy to tamper with cocaine and unlawfully tampering with the 21.35kg of cocaine seized from Umeibe and Ezenwanne.
CP Kyari was charged alone with the case of attempting to obstruct NDLEA Officials in the conduct of their duties by offering them a bribe.
However, the presiding judge, Justice Emeka Nwite fixed the date for ruling after listening to submission by the prosecuting and defence lawyers.
